Uber accident: whose insurance pays?

Hurt as a passenger or hit by a rideshare driver? Several policies may apply. Here is which one pays.

After a rideshare crash, the hardest question is often which insurance pays. With Uber and Lyft, the answer depends on what the driver’s app was doing at the time of the crash.

It depends on the app status

  • App off — the driver’s personal insurance applies

  • App on, waiting for a ride — limited rideshare coverage applies

  • On the way to a rider, or during a trip — the rideshare company’s larger policy generally applies

Whether you were a passenger, another driver, or a pedestrian, more than one policy may come into play. Do not give a recorded statement before you understand which coverage applies to you.
